A lower court ruling was upheld by an Oklahoma appeals court in the lawsuit against Disney and Pixar over the likeness rights of Lightning McQueen from CARS, according to The Hollywood Reporter.

A lower court ruling was upheld by an Oklahoma appeals court in the lawsuit against Disney and Pixar over the likeness rights of Lightning McQueen from CARS, according to The Hollywood Reporter. Racecar driver Mark Brill alleged the character’s red paint job and yellow 95 was too similar to his race car and infringed on his publicity rights. The court used the standard set in the Vanna White v. Robot-With-A-Blond-Whig case, which argued that there is enough difference between the fictional character and the real person that the average person would not mistake one for the other.
