After being indicted by a federal grand jury last Thursday in Los Angeles, Gilberto Sanchez was arrested by FBI agents on Wednesday in New York for the alleged piracy of X-MEN ORIGINS: WOLVERINE last March, reports VARIETY. The charges against the 47-year-old claim that he uploaded the film to megaupload.com before its theatrical release. Both 20th Century Fox and the U.S. Attorney's Office do not know how the man, who has no connection to the film business, obtained the unfinished copy of the film.

In the most damaging piracy case in Hollywood history, Fox believes 15 million people downloaded the film. If only half of those viewers did not go to see the film in theaters thereafter, the studio lost $50 million.

If convicted, Sanchez could spend three years in jail and be fined.
