U.S. District Judge Otis D. Wright has opened the door to allow Warner Bros. to depose the heirs of Superman creators Joe Shuster and Jerry Siegel, according to The Hollywood Reporter. The case had previously been delayed to await the heir's lawyer Marc Toberoff's appeal of a court ruling throwing out his claim that WB sued him as retaliation for winning a previous case that returned some rights to the Man of Steel to Joanne Siegel, Laura Siegel Larson, Jean Peavy and Mark Peavy. As part of his payment deal with the heirs, Toberoff would take a big chunk of the copyright himself. WB claims Toberoff wrongly persuaded his clients to renege on deals regarding the character.
